  • Revocable Living Trust: Avoids conservatorship, probate and reduces or eliminates federal estate taxes for a married couple.

What is a trust?

Good question…..it’s a legal document that transfers assets from your name into the name of a trustee for the benefit of asset protection and management during and after your lifetime. There are 3 parties to a trust: (1) the settlor or the creators of the trust; (2) the trustee(s), who manage the assets inside the trust; and (3) the beneficiaries. Typically, the parties to the trust are one and the same person(s).

  • Funding your Trust: We prepare the letters of instruction which enable you to get assets transferred into your trust. We analyze proper titling and beneficiary designations on assets and provide instructions appropriate for your plan .
  • Personalized Service with an Attorney Only: So that all questions are answered and help is provided, with no
    trust2additional cost. This service is included with the package price.
  • Pourover Will: Transfers any assets left outside the Trust at death into the Trust and revokes any prior Wills. Also names guardians of minor children, if any.
  • Durable Power of Attorney: Allows a spouse or anyone else of your choice to sign documents and handle affairs for you. This document is particularly helpful if mental or physical disability prevents a person from managing his/her own affairs. If properly drafted, it can permit the agent to do Medi-Cal planning or implement other asset protection strategies during your incapacity.
  • Advanced Health Care Directive(s) and Living Will(s) which give directions to physicians and family members regarding continuation of life support systems in the event of terminal illness. Authorizes someone to make healthcare decisions for you if you are incapacitated.
  • HIPPA Release: Complies with federal and state statutes enabling persons of your choice to obtain medical records.
  • Community Property Agreement which classifies all property as community, in order to ensure complete forgiveness of capital gains tax upon the death of one spouse. Can also help fully fund each spouse’s estate tax exemption.
  • Trust Certification: Provides a summary of key portions of your Trust for third parties such as banks or other financial institutions.
  • Estate Planning Portfolio Binder, otherwise referred to as the Owner’s Manual:Besides containing copies of the above documents, it contains all necessary documents and directions regarding procedures to follow if someone becomes incompetent or if there is a death. Various other informational documents are also provided regarding where assets are located, wishes for memorial services and other information.
  • I.D. Card: To keep in your wallet, readily available, when you acquire new assets—so you properly place later acquired assets into your Trust.
  • Free Review: Every 3 years you are entitled to a free review of your Trust.

Do the benefits of estate planning warrant the cost?

It is important to balance the cost of estate planning versus the cost if no planning is done. Potential costs of probate, guardianship or conservatorship proceedings, tax and other expenses which can be minimized or eliminated through estate planning should be weighed against the cost of estate planning.

How do I select the right attorney?

Cost of estate planning will vary substantially from attorney to attorney. It is very important that the quote for a living trust include consultations, ancillary documents and help in getting assets transferred into the trust, since a trust without assets will NOT avoid probate.Beware of mail order trusts, or trusts marketed by non-attorneys. Does the attorneyspecialize in estate planning or is it one among many so-called specialties? Each individual estate plan is unique and must be designed specifically for you. Paying for an estate plan without personally meeting with the attorney is like having surgery without the doctor in the room. Results can be disastrous, and non-attorneys have no insurance with which covers errors made in the practice of law! Documents are worthless if they don’t fit yourneeds. We have reviewed plans which could create hundreds of thousands of dollars in unnecessary tax liability due to improper drafting. By the time liability arises, the ‘company’ may be long gone or uncollectible. Be selective in choosing the attorney who drafts your plan. Look for an attorney with the sole specialty of estate planning.
